Issuance of Dispensations
The technical and safety dispensations are only issued when circumstances prevent the immediate rectification of a non-compliance with a specific Convention or Code.
When requesting a dispensation, the owner/operator or the master/person in charge of the vessel must submit to the Administration specific information regarding the details and circumstances concerning the non-compliance and all relevant supporting documentation demonstrating the nature of the deficiency and difficulties encountered in rectifying the non-compliance. In addition, the owner/operator or the master/person in charge of the vessel shall provide a proposed corrective action plan to rectify the issue as expeditiously as possible.
Dispensation Letters shall be issued with a specific term limit of validity either for a single voyage or for a set period of time, and shall be limited to the minimum period of time necessary for the ship to rectify the deficiency or non-compliance.
If the vessel is already in a port when the non-compliance is discovered, the owner/operator or the master/person in charge of the vessel must provide information on why the deficiency cannot be rectified at the vessel’s current port.
A copy of the dispensation will be provided to the vessel’s classification society for information and/or to instruct that a short-term statutory certificate should be issued. If the non-compliance also affects the validity of the certificate of class, the classification society may also impose additional requirements pending rectification of the non-compliance.

The objective of a company ISM & ISPS audit is to seek information about the Safety Management System and to determine (by objective evidence) the degree of compliance with the applicable rules, regulation and standards (ISM Code, ISPS Code, ISO etc), and the documented company procedures.

The Internal audits to carried out on board and in the office with intervals not exceeding 12 months.

Ship Flag Inspection

Our qualified Flag State Inspectors will conduct ship audits and ship flag inspections with authorization by various Flag Administration in Vietnam areas & other countries.

Ship Flag Inspection to be used by Flag States to ensure satisfactory standards.

Ship Flag Inspection shall be carried out by approved Flag State Inspectors and include verification of statutory documentation and a general examination of the vessel’s structure, machinery and equipmentAs well as, a more thorough inspection and/or operational testing of fire fighting equipment, life saving appliances and safety equipment.

Objectives of flag state inspections

  • Support the quality shipping objectives of Flag Administration.
  • Enforce high standard of compliance with international and national rules and standards for flagged ships.
  • Verify the actual condition of flagged ships conform to the certificates they carry. The scope of the verification includes:
    • Hull, equipment and manning;
    • Safety management; and
    • Security systems
  • Ensure that the ship’s crew can effectively:
    • Co-ordinate their activities in an emergency situation;
    • Perform functions vital to safety; and
    • Prevent or mitigate pollution
  • Monitor the work performed by Recognised Organisations and nominated surveyors that act on behalf of the Flag Administration.

Inspection Process

  • Qualified surveyors from Flag Administration conduct ship flag inspection
  • The master receives an inspection report upon the completion of an inspection
  • The master is required to rectify any deficiencies in accordance with the conditions stated in the inspection report

Flag State inspections are conducted by Flag State Inspectors from the Tuvalu Ship Registry (TSR) or by maritime surveyors that have been appointed by TSR which may include reputable survey companies or classification societies.

The purpose of carrying out a Flag State Inspection is to review the general condition of the ship, its operations and documentation to ensure that the minimum standards are present. TSR believes this will result in better Port State Control (PSC) results which reduced PSC detentions.

If TSR considers a PSC detention unfair, then TSR will be willing to discuss the matter with the appropriate Port State. However if the vessel is deficient, then recommendations will be given to ensure that necessary actions are taken to avoid further detentions.

Detentions not only result in loss of earnings to ship owners / operators, but are detrimental to the reputation of the flag.

The Annual Flag State Inspection policy has helped in improving the safety of vessels and in considerably lowering the number of detentions. This policy will therefore be pursued more than ever.
This Administration tries to keep the Owners’ expenses at a minimum but the cost of an inspection may vary from one country to another. As Flag State Inspections should be carried out annually with a three (3) months window, it is suggested that Owners arrange for inspections to be carried out in a suitable/convenient port (pricewise etc …).

The Panamanian Registry has to take all the necessary measures to guarantee the safety at sea of ​​the vessels that fly its flag as dictated by the United Nations Convention on the Law of the Sea (UNCLOS) in its Article 94.
 
It is therefore that among these current measures of the General Directorate of Merchant Marine are:
 
Certification of some certificates was delegated to Organizations Recognized by Panama for that purpose. Conduct an annual flag safety inspection of your ships through a Flag State Inspection Program. Monitoring of the results of the annual inspections. Annual Evaluation of the flag state inspectors. Analysis of the results of flag inspections. Conduct audits Recognized Organizations to certify our fleet. Analyze Port State reports to the ships of this registry that visit different ports worldwide.

The Flag State Inspection Program was created with the goal of assisting ship owners and operators with an annual compliance inspection. This program was designed to ensure that safe and secure operation of  vessels are maintained and managed to reduce the number of deficiencies and detentions received during Port State Control inspections as best as we possibly can. The program incorporates multiple inspection types that are necessary to prevent, identify, and rectify any issues related to safety, security and environmental protection.

The program is not intended to replace surveys for the issuance of class and statutory certificates. Such activities will continue to be performed by duly recognized organizations. Each inspection has a different purpose, but the final goal is to assist the ship owner/operator in complying with the application of international standards prescribed by a host of treaties and conventions such as Safety of Life at Sea (SOLAS),  the Marine Pollution Convention (MARPOL), The International Convention on Standards of Training and Certification for Watchkeepers and Seafarers (STCW) and The Maritime Labour Convention (MLC) as well as national regulations and requirements prescribed by the Administration. The main goals of the program are to assist owners and operators to conduct their vessels safely, efficiently and cost-effectively.

As a continued effort to reach our goal of zero deficiencies and detentions, Dominica has also developed the Detention Prevention Program. This program entails daily monitoring of our vessels’ performance and identifying vessels that are having difficulty complying with mandatory instruments. These vessels are placed in the Detention Prevention Program and additional support is provided to the owner and operator.

The aim of Flag Safety Inspections (FSIs) is to enhance the safety standards of Sierra Leonean vessels and decrease the number of deficiencies that may result in the detention of the ship from Port State Control Authorities.

Pursuant to the requirements of Palau Maritime Regulations Chapters 2.13 and 5.16, and Title 7 of the Palau National Code Section 630, each ship sailing under the Palau Flag shall be subject to Annual Safety Inspection (ASI), in order to determine whether it complies with the International Conventions and Regulations that Palau is member of. Annual Safety Inspections (ASIs) shall be carried out once a year, within a time window of three (3) months prior or after the designated anniversary date of the ship’s registration. Such inspection(s) will be carried out by Flag State Inspectors accredited by the Palau Ship Registry Administrator.

Certain ships may be subject to special/additional as well as more frequent inspections whether circumstances merit this, in order to attain the aforementioned aims.

All ships registered with the Bahamas have an “anniversary date”. The anniversary
date is usually three months after the date of provisional registration.

  • The anniversary date is generally fixed for the duration of time that the ship remains registered with The Bahamas.

Deficiencies found on ships during Port State and Flag State inspections are rigorously followed up by our Inspectors. Flag state inspections are special programs by flag states performed annually in most cases by individual approved inspectors

Types of flag state inspections are usually one of the following:

  • Annual inspection
  • Special inspection when required after detention or doubts about the ship
  • Pre-registration inspection before the registration documents are issued

Purpose of flag state inspections could be one of the following or even all:

  • To make sure that the vessel is us up to the flag standard before registration
  • To verify the safety of the vessel and seaworthiness
  • To review that all parts involved in certification of the ship are doing their parts according to the International and national regulations

Ship Navigational Assessment

The purpose of a navigational assessment should be to identify poor practices, to continuously improve navigational standards to ensure safe and effective voyages and to assure companies that high standards of navigation and watchkeeping are being maintained.

The navigation equipment of the vessel consists of a set of devices that determine the ship’s position, speed, course, and also ensure safety during navigation in shallow waters or when meeting other vessels. Some of them have been used by seafarers for a long time, while others represent new technologies.

Ships are selected for inspection based on a calculation of the history of inspection and generic factors (such as age, shiptype, Ship risk type etc.). Each aspect of the history and generic factors is weighed and the outcome is a priority indication.

Port State Control Inspection Checklist

A Port State Control (PSC) inspection checklist is used by crew members on board to ensure compliance with international regulations in the condition, operation, and manning of the ship. This PSC inspection checklist includes important reminders about critical items such as The Muster List must include all details required by SOLAS Ch III Reg 37. and All required certification and seafarer documentation should be available as originals., among others. Use this checklist to immediately rectify detainable deficiencies and easily perform the following:

  1. Inspect the maintenance of the ship and equipment, emergency preparedness, fire safety, and certificate and documentation.

  2. Take and annotate photos of failed items and add notes where necessary.

  3. Instantly notify key personnel about non-compliant items.

  4. Assign corrective actions for deficiencies to be rectified.

  5. Complete the PSC inspection report with a digital signature.

Ship Technical Inspection and Assessment

SIRE (Ship Inspection Report Programme) refers to a set of standards provided by the OICMF (Oil Companies International Marine Forum) to identify operational deficiencies in ships. Conducted by tanker owners and operators, SIRE is a tanker risk assessment tool to determine the ship’s safety and is valuable for ship charterers, ship operators, terminal operators, and government bodies.

Technical Superintendent Visit

Responsibilities:

  • Coordinate and carry out maintenance work on board and monitor the quality standard.
  • Planning, organizing, supervising repairs, inspections and dockings and the preparation of final technical and financial reports.
  • 1st point of contact for the international crew in case of technical questions or defects.
  • Supervising and providing technical advice and support to the Chief Engineers on board.
  • Instructing and monitoring the maintenance progress and quality on board via the PM System (PMS). 
  • Investigating and analyzing technical defects and taking preventive and corrective measures in a timely manner.
  • Conducting inspections and guiding surveys on board by external parties.
  • Drawing up and monitoring maintenance budgets.
  • Approve purchase orders and monitor / follow up on goods received.
  • Liaise with suppliers, classification societies and other external parties.
